What is a Notary?
The notary is a legal professional, vested with public faith by the State, who provides legal certainty and certainty in the acts and facts of which he attests, always maintaining a high level of professionalism, total impartiality in the lenders of the service and full autonomy in their decisions, which are only limited by the legal framework and the rule of law.
The notary exercises his function independently of public power and individuals, being responsible for receiving, interpreting, drafting and giving legal form to the will of the appearing parties and embodying it in a public and authentic instrument, drafted under his responsibility and that can be a public deed, if it is a matter of attesting to a legal or material act, for example a notification or a proof of facts.
The notary preserves and reproduces the instrument, thus providing security and tranquility to the society it serves. It also assists local and federal authorities in the calculation and collection of taxes and fees and ensures that the registration procedure necessary for the publication of the acts granted before it is complied with.
What is a protocol?
Protocol is the set of folios formed or to be formed in books or volumes, numbered, sealed and authorized in which the notary, observing the formalities established by this Notary Law, must record the public deeds and notarial records that, respectively, contain the legal acts or facts submitted to his authorization, with their appendices, indexes and corresponding control books or records.
The Function of the Notary in the State of Baja California Sur
The exercise of Notary in the State of Baja California Sur, is a function of public order that is in charge of the Constitutional Governor of the State and that by delegation is entrusted to legal professionals by virtue of the patent that for such purpose grants them the Executive of the State in order to perform it in terms of the Law.
The Notary in Baja California Sur, is responsible for:
Give formality to the legal acts that require or request the interested parties and attest to the facts or acts that are known to him, at the request of the interested party.
The Function of the Notary as a State Certifying Officer of Baja California Sur
In addition to the function of public order that the Notary performs at the request of individuals, the Notary keeps a special protocol to record in it the operations in which the Government of the State of Baja California Sur, the decentralized or coordinated public bodies of State or Municipal character of the Entity are part and for the granting of deeds that official institutions promoting housing or regularization of land tenure celebrate.
The Function of the Notary as a Certifying Officer in Operations in which the Federal Government intervenes
Legal acts related to real estate in which the Federation is a party and that in the terms of the Law require the intervention of a notary, will be held before the Notaries of the Federal Real Estate Patrimony that the Secretary of the Function of the Notary as a Certifying Officer in Operations in which the Federal Government Intervenes will appoint.
